Guidance from The British Fireworks Association

    Dear all,
    the time is upon us to stand up for our industry and put an end to the anecdotal and hearsay views of a vociferous minority who seem determined to destroy firework use in the UK.

    The BFA has been working tirelessly with Local Authorities, Government and BEIS, and the Department for Product Safety but we cannot do everything so I ask that you take time to assist us.

    The first thing that is needed as a priority is that YOU submit Freedom of Information requests to Police, Fire and Rescue, NHS and Trading Standards in your area to help collect real facts about firework use and abuse. To make this easier for you we have created the questions you need to be asking. If you do this we will at least obtain information which is easily comparable, factual, and from trusted sources. This is a priority due to the timescales allowed in any department responding to an FOI request.

    To the police:

    Dear Sir,

    Under a freedom of Information request, could you provide me with the
    following information covering the period 2013 to 2018 (inclusive): -

    1) Total number of assaults on Officers, broken down per year?
    2) Total number of assaults on Officers involving Fireworks, broken down per year?
    3) Total number of assaults on Officers involving Dogs, broken down per year?
    4) Total number of prosecutions for firework misuse/abuse, broken down per year.

    I am happy to receive the information as an excel or csv file and do my own analysis.

    To Trading Standards:
    Dear Sir,

    Under a freedom of Information request, could you provide me with the
    following information covering the period 2013 to 2018 (inclusive): -

    1) The total number of noise complaints (regardless of cause) made in relation to domestic premises, broken down per year?
    2) The total of noise complaints made relating to fireworks from domestic premises, broken down per year?
    3) The total of noise complaints made relating to dogs barking from domestic premises, broken down per year?
    4) Total number of prosecutions for firework misuse/abuse, broken down per year.
    I am happy to receive the information as an excel or csv file and do
    my own analysis.

    To the Fire Service
    Dear Sir,

    Under a freedom of Information request, could you provide me with the
    following information covering the period 2013 to 2018 (inclusive): -

    1) Total number of attacks on Fire Crews, broken down per year?
    2) Total number of attacks on Fire Crews involving Fireworks, broken down per year?
    3) Total number of attacks on Fire Crews involving other means (paint, rocks, bottles, dogs etc), broken down per year?
    4) Total number of attacks on Fire Crews by fireworks requiring Police intervention, broken down per year.
    5) Total number of attacks on Fire Crews involving other means (paint, rocks, bottles, dogs etc) requiring Police intervention, broken down per year?
    I am happy to receive the information as an excel or csv file and do my own analysis.

    and to the National Health Service
    Dear Sir,

    Under a freedom of Information request, could you provide me with the
    following information covering the period 2013 to 2018 (inclusive): -

    1) How many A&E visits as a direct result of a firework injury.
    2) How many hospital admissions as a direct result of a firework injury.
    3) Can you confirm if the figures supplied include or exclude "bonfire related injury" ie Ember burns, smoke inhalation etc.
    I am happy to receive the information as an excel or csv file and do my own analysis.

    To find out who to contact, use GOOGLE and search for the area you wish to query, which organisation you need, and tag on FOI of Freedom of Information request.

    for example "YORKSHIRE HEALTH SERVICE FREEDOM OF INFORMATION REQUESTS" Gives a number of results. Because there are so many options it will be down to you to find a suitable active link to make your request. Using the questions above (copy and paste as you like) submit the request. It may be prudent to ask also that if you have the wrong department that they point you in the right direction.

    Don't worry about duplication, if two or more members ask the same questions they will advise that they have already responded and that the answers can be found here...etc.

    For those who may see no value in this then I will say that we have already done quite a swathe of Scotland. These results have been presented to people who need to know and they were suitably surprised by how low they are. Note these are for a 6-year period, they are FACT and they can be verified.

    I'm on it for Leicestershire. May also branch out to Derbyshire, Staffordshire, and Warwickshire if no-one else on here is local to there o_O. @TGR Should we post it on this thread or PM you?

    I have also contacted a number of local venues and organisations to confirm that their annual charity/ bonfire displays do solely rely on retail firework sales and amateur firers. It is astounding how many "organised displays" attended by local anti's, do just that! I have tagged these on a FB post by a pro-fireworks page asking for surveys to be filled in and written responses to be submitted. Anything else I can do on this side of things?

    The next step is to contact all of your customers.

    Here is a suitable chunk of information to include in your e-mail:

    Dear (customer)
    You may be aware that there has been a recent request for a Government Enquiry into the sale and use of fireworks in the UK. This is a chance to get your views across as either someone who relies on fireworks for a living or as someone who simply enjoys using a lawful product responsibly.

    There are two means of getting information to the government. One is an online questionnaire (riddled with inaccuracies but we will live with that for now) and the other is a written submission where a text response and images if necessary, can be submitted.

    It is very important that you have a chance to have your say because of the repercussions that any changes to legislation, or even a ban, would bring.

    It is clear from this that they DO want input from "...lots of different organisations and groups, including central and local government, the emergency services, medical professionals, health and safety and accident prevention specialists, people who work with or sell fireworks, and cultural and religious groups for whom fireworks often have a special significance."

    Just so you are aware, the request for Enforcement Authorities to have their say too has been made and circulated.

    Getting the facts from all sides is the only way this will be resolved. If you are a business with employees then make sure you are clear that job losses would occur.

    we would also suggest that you reiterate that you are already a heavily regulated industry/user; strict laws exist and that you would welcome an increase in penalties for misuse, and would like to see stricter enforcement of the existing laws.
